DIP Webinar: The Padilla Advisory: Duty of Criminal Defense Counsel to Advise Clients of Immigration Consequences - May 12
On March 31, the Supreme Court issued its watershed decision in Padilla v. Kentucky, holding that the Sixth Amendment requires criminal defense counsel to advise their clients of the immigration/deportation consequences of criminal charges and criminal pleas. Failure to do so constitutes ineffective assistance of counsel.
This webinar training is a practical primer for defense attorneys on the Padilla decision.
It will cover the following:
What did the Supreme Court say?
What must defense counsel do to meet their obligations under Padilla?
What are some of the main immigration consequences of criminal dispositions?
What resources are available to help defense counsel meet these obligations?
What should a public defender office consider when institutionalizing immigration advisal in their offices?
Is the Padilla decision retroactive?
What are some considerations for post-conviction relief under Padilla?
Questions & Answers
This training will use examples and hypotheticals, but is not primarily a substantive training on immigration law. Check www.defendingimmigrants.org for updates on future immigration consequences of crimes trainings.
Presenters will include: Immigration attorneys and public defenders throughout the country with expertise in this area.
Who can register for this training?
Indigent defenders (including alternate/conflict defenders) and those regularly assisting such defenders.
? If space allows, we will open registration to private criminal defense attorneys and immigration advocates on 5/7/10.
? No government employees (except public defenders in states with state-run systems) or individuals involved in prosecuting immigrants in criminal or immigration court may participate.
? Each registration requires that the participant affirm his/her defender affiliation. Any misrepresentations or failure to respond to inquiries about affiliation will result in forfeiture of the $10.00 fee and these individuals will not be provided information about the webinar. To keep the costs down, there will be no refunds. Every participant can use a speaker phone and have additional listeners, but the conference call system will only accept one phone call for each registration and $10.00 payment.
